"PROBLEMA NA CONCEITUAÇÃO DE LEI EM JEREMY BENTHAM:” PODE SER JUSTIFICADA A PUNIÇÃO LEGAL?
Abstract
This text investigates how Bentham's ethical project based on the principle of minimize suffering faces the question of
justifying legal coersion. It is argued that, notwithstanding Bentham's success in stating the basis for a system of minimal coersion, he does not give the necessary criteria to evaluate the results of that system. As matter of conclusion, it is argued that the -minimal
suffering” it is not always a "fair suffering-. That is, without a theory of justÊce Bentham’s utilitarianism does not succeed in justifying the necessity of the minimal suffering produced by the system of legal minimal coersion. "After a discussion so abstruse and so fatigating, something may be expected by way of apology from the writer. something by way of satisfaction to the reader. Labour is swetened by utility".
