CONSIDERAÇÕES ACERCA DA TUTELA LEGAL DA DOAÇÃO DE ÓRGÃOS DE ANENCÉFALO RESOLUÇÃO CFM Nº 1.752/04
Abstract
The present work purposes to present a critical bioethics boarding regarding the contends around the legal guardianship of the donation of agency of newborns with anencephaly, passing over the Resolution nº 1.752/04 that today allows the doctor to make transplants of agencies of newborns with anencephaly until the possible modifications of this normative instrument, its looks and
interpretations. It is thus treated to analyze it arrives in port legal that the withdrawal of agencies of newborns with anencephaly for ends of transplants supports, as much in the legal question how much in the perspective of the most general bioethics. An analysis of the present time of the bioethics discussion is become fullfilled that encloses and in such a way marks out with buoys the
substance and the pointed perspectives of the area of the Medicine as much as the area of the Law.
